96-7-B IN RE: DISPOSITION OF EVIDENCE IN PROCEEDINGS TO DETERMINE INCAPACITY – ORDERED 2/22/1996 BY JOHN DEAN MOXLEY, JR.

EXCERPT: “It appearing that evidence relevant to the issue of incapacity under Section 744.331 Florida Statutes should be preserved should there be a subsequent petition to determine incapacity under Section 744.3201 Florida Statutes or a suggestion of capacity under Section 744.464 Florida Statutes, IT IS ORDERED, that the Clerk of the Court shall preserve any evidence admitted under Section 744.331 Florida Statutes in a hearing to determine incapacity for a period of ten (10) years from the date said evidence was introduced. DONE AND ORDERED this 22nd day of FEBRUARY 1996.”
