16-20, SUPERSEDES 02-31 IN RE: JURY - BREVARD AND SEMINOLE COUNTY JURY EXCUSE GUIDELINES - ORDERED 6/30/2016 BY JOHN D. GALLUZZO
In order to improve the administration of justice in the Eighteenth Judicial Circuit, and pursuant to Chapter 40, Florida Statutes, it is therefore ORDERED:
- The Clerks of the Circuit Court shall purge from the jury lists in the same manner that is authorized by §40.022 Florida Statutes, convicted felons, adjudicated incompetent, and deceased persons.
- No person shall be purged from said list if their competence has been restored (or civil rights have been restored) whichever is applicable, provided an affidavit has been filed pursuant to §40.022(3), Florida Statutes. Any person so removed shall be added upon filing of said affidavit.
- The jury clerk may excuse members of a jury venire prior to reporting on the initial day of service for reasons set forth in §40.013(1)–(4) and §40.013 (7)–(10) Florida Statutes. All other requests to be excused or for disqualification are to be directed to a judge.
- A jury clerk may postpone jury service as set forth in §40.23(2) Florida Statutes.
- Upon the jury clerk excusing or postponing a member of the venire, the jury clerk will document it by annotating on the jury venire list the basis for doing so and will retain the documented venire list until jury service for all jurors who have been called has been completed.
- On the initial day of service, the judge will completely qualify the jury and will address all requests to be excused from service from reporting venire members.
