15-15-B, SUPERSEDES 93-93-Cr-B IN RE: CRIMINAL - NOTICE OF EXPIRATION OF SPEEDY TRIAL/MOTION FOR DISCHARGE/DEMAND FOR SPEEDY TRIAL - ORDERED 1/27/2015 BY JOHN M. HARRIS
WHEREAS, notices of expiration of speedy trial, motions for discharge and demands for speedy trial in criminal cases often require expedited hearings; and,
WHEREAS, attorneys representing criminal defendants have on occasion included notices of expiration of speedy trial, motions for discharge, and demands for speedy trial together with other motions, resulting in routine scheduling of hearings on said motions; and,
WHEREAS, there have been delays in the scheduling of notices of expiration of speedy trial, motions for discharge, and demands for speedy trial it is hereby: ORDERED that;
- All notices of expiration of speedy trial, motions for discharge, and demands for speedy trial shall be filed as separate pleadings with correct descriptive titles.
- The attorneys filing notices of expiration of speedy trial, motions for discharge, and demands for speedy trial, are to immediately provide the judge to whom the case is assigned a copy of said motion within 24 hours of filing, by hand delivery or email.
- The Clerk of Court shall provide the judge to whom a criminal case is assigned by electronic means, copies of notices of expiration of speedy trial, motions for discharge, and demands for speedy trial within 24 hours of filing.
