13-32-S IN RE: FORECLOSURE -MORTGAGE FORECLOSURE SALES – CANCELLATION BY CLERK - ORDERED 6/28/2013 BY ALAN A. DICKEY
The court finds that the Clerk of the Court should not proceed with a foreclosure sale when the clerk determines the sale has not been properly published according to law or when the defendant has obtained a stay in bankruptcy, even if no order has been entered cancelling the sale, it is therefore, ORDERED that the Clerk of this Court is not to proceed with a mortgage foreclosure sale when the clerk determines that the sale has not been properly published according to law or that a stay in bankruptcy exists.
