09-19-S IN RE: DOMESTIC RELATIONS - FAMILY DIVISION - SUPPLEMENTAL PETITIONS FOR MODIFICATION - ORDERED 03/05/2009 BY CLAYTON D. SIMMONS

Supplemental Petitions for Modification in Family Division cases must be filed with the clerk along with the appropriate filing fee, if applicable, and served on the opposing party. Such petition shall carry the same case number as the final judgment or order for which modification is sought and shall remain assigned to the same division where that final judgment or order was obtained.

A party wishing to modify an existing Title IVD Child Support order to address parenting plan issues regarding the children must file a Supplemental Petition for Modification in the Title IVD case and serve the other parent or party. The attorney for the Department of Revenue does not represent the other party in the case and should not be served.

DONE AND ORDERED this 5th day of March 2009.
