04-09-B, SUPERSEDES 86-4-CI-B IN RE: DISPOSITION OF CERTAIN BULKY EXHIBITS NOT COVERED UNDER Fla.R.Civ.P. 2.075 (f) - ORDERED 2/10/2004 BY JAMES E.C. PERRY
It appearing to the Court that the Clerk has neither the storage space in the Archives Center or the physical environment conducive to the preservation of certain bulky exhibits not admitted into evidence at Trial, but which were submitted as part of depositions or pleadings, e.g. X-rays, voluminous medical records, construction plans, maps, replicas, models or facsimiles of items. It is therefore ORDERED AND ADJUDGED that the Clerk is hereby directed and authorized, upon giving thirty (30) days written notice to the attorneys of record, or any party not represented by an attorney, who filed such exhibit (where the name and address of such party is apparent from an examination of the court file), in every action wherein a Final Judgment or Order of Dismissal has been rendered over ninety (90) days and no appeal is pending, either to release upon request or destroy the itemized exhibits thirty (30) days following such notification. If more than one party request a particular exhibit, such exhibit shall be released to the party who sought the introduction of such exhibit into evidence.
