										<content:encoded><![CDATA[<p>EXCERPT: “WHEREAS there are instances in a dissolution of marriage action where prior to the conclusion of the action an order for temporary child support has been entered and an arrearage has accrued but the final judgment does not address this arrearage. WHEREAS the law is clear that when there is an arrearage from a temporary child support order and the arrearage is not addressed in the final judgment the arrearage is voided and no longer collectible. It is thereupon, ORDERED: That the Clerk of the Court for Brevard County shall be authorized to zero out the arrearage that exists in their records as a result of a temporary child support order when a final judgment of dissolution of marriage is entered which does not address or include any provisions regarding the temporary support arrearage.<br />
This order will take effect immediately. DONE AND ORDERED this 14TH day of MAY 1997.”</p>

										<content:encoded><![CDATA[<p>The judges of Brevard County have decided that it is in the best interest of the litigants and constituents of the Family/Domestic Relations Division that the court implements a uniform method for applying payments and requiring their orderly processing by the Clerk and uniform accounting of the same.</p>
<p><strong>NOW THEREFORE</strong> I, John M. Harris, pursuant to the authority vested in me as Chief Judge of the Eighteenth Judicial Circuit under <a title="Search the Florida Administrative Code Rules and Regulations. Opens in a new browser window." href="https://www.flrules.org/" target="_blank" rel="noopener">Rule 2.050, Fla.R.Jud.Admin</a>, cause the same to take effect and <strong>IT IS ORDERED</strong>:</p>
<ol>
<li>For the purpose of ensuring that the Clerk’s administrative fees under <a title="Search Florida Statutes. Opens in a new browser window." href="http://www.leg.state.fl.us/STATUTES/" target="_blank" rel="noopener">Section 61.181, Florida Statutes</a> are correctly deducted from the child support payments made directly to the Clerk, the Clerk shall determine the weekly rate of child support and/or arrearage amounts and shall implement this rate on a weekly basis, regardless support was calculated by the court on a bi-weekly, semi-monthly, monthly or other term in the support order.</li>
<li>The system shall not affect how the employer/respondent pays child support under the terms of the support order.</li>
<li>The Clerk shall be responsible for accounting for a 53-week year, when necessary.</li>
<li>This Administrative Order shall not alter or otherwise amend any portion of an order for support except otherwise provided herein.</li>
</ol>

										<content:encoded><![CDATA[<p>Whereas, pursuant to Title IV-D of the <a title="42 U.S. Code § 651 - Authorization of appropriations. Opens in a new browser window." href="https://uscode.house.gov/view.xhtml?req=(title:42%20section:651%20edition:prelim)" target="_blank" rel="noopener">Social Security Act, 42 U.S.C.§651</a>, et seq., and <a title="Search Florida Statutes. Opens in a new browser window." href="http://www.leg.state.fl.us/STATUTES/" target="_blank" rel="noopener">Florida Statute §409.2567</a> and the Department of Revenue is designated as the State Agency responsible for the administration of the Child Support Enforcement Program in the State of Florida, Whereas, when the following case types ceases to be a Title IV-D case;</p>
<ul>
<li>Request to Establish an Account (Interstate case)</li>
<li>Request to Establish a Registration Account (Interstate case)</li>
<li>CSE Transmittal (case involving two states)</li>
</ul>
<p>The Department of Revenue as part of its duties as the State’s Title IV-D Agency notifies the Clerk of the Court of Brevard County of that fact and requests the Clerk to redirect payments to the proper person. Now Therefore, <strong>It is Ordered</strong>;</p>
<p>1. That upon notification by the Department to the Clerk of the Court of Brevard County, that the following case types have ceased to be a Title IV-D case;</p>
<ul>
<li>Request to Establish an Account</li>
<li>Request to Establish a Registration Account</li>
<li>CSE Transmittal</li>
</ul>
<p>and that payments should be redirected; the Clerk of the Court is hereby authorized to proceed as requested by the Department.</p>
<p>2. That the Department’s notice to the Clerk shall further state whether the accounts kept by the Clerk relative to the case should be closed and/or zeroed out. The Department’s notice shall state the reason for the action requested. This order will take effect immediately and will be applicable to cases filed on or after February 28, 2001.</p>
<p><strong>DONE and ORDERED</strong> the 21st day of April 2010.</p>
